By using our service, The Legacy Email ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and The Legacy Email, operated by The Legacy, a business registered and based in India.
The Legacy Email provides a platform for users to write, schedule, and send emails to specified recipients at a future date, ranging from one (1) year to one hundred (100) years from the date of scheduling. The Service does not require user accounts. Once an email is scheduled and paid for, our system will store the content and attempt to deliver it on the scheduled date(s).
You are solely responsible for the content you create and the information you provide. By using the Service, you agree to the following:
The Service is fee-based. The price for scheduling an email is calculated based on the number of scheduled sending events and their respective delivery dates, as detailed on the main page. All payments are processed through secure third-party payment gateways (e.g., Stripe, Razorpay, PayPal). We do not store your full credit card information.
Payments may be made in U.S. Dollars (USD), Indian Rupees (INR), or other supported currencies as displayed at checkout. Currency conversions, if applicable, are handled by our payment partners and may include additional fees. You are responsible for any foreign exchange or transaction fees charged by your card issuer or bank.
Due to the long-term nature and operational costs of storing and attempting future delivery of your message, all purchases are final. We do not offer refunds once an email has been successfully scheduled and paid for.
You acknowledge and agree that in the event the Service is discontinued, interrupted, or unable to deliver your scheduled email(s) for any reason, including but not limited to technical failures, business closure, or acts of God, no refunds or compensation will be provided.
The Legacy Email is a digital-only service. No physical products are shipped as part of the Service. All deliveries are performed electronically via email to the recipient addresses provided by you at the time of scheduling.
Because the Service does not involve physical goods, there are no shipping charges and no exchanges applicable. If at any time we introduce optional physical products (such as gift boxes, certificates, or merchandise), their shipping, return, and exchange policies will be specified separately at the point of sale.
You retain full ownership and all intellectual property rights to the content (subject and body) of the emails you create. We claim no ownership over your content.
The branding, design, and source code of The Legacy Email service are our exclusive property and are protected by copyright and other intellectual property laws.
Your scheduled messages are stored securely by our Service. However, the Service does not provide end-to-end encryption, which means that messages may be accessible to us in a readable format.
By using the Service, you acknowledge and agree that:
To maintain the integrity and safety of our Service, we collect certain technical and usage information necessary for operation, security, and abuse prevention.
We do not disclose message content for marketing purposes. If our processing involves third parties, such providers handle data under their own policies and applicable legal protections.
We may use automated abuse-detection tools to assess scheduled messages and detect spam, fraud, or other risks. These tools receive only the information necessary for classification (such as recipient addresses, subject line, and minimal message content or excerpt) and provide a short result used to decide whether to accept, block, or review a message. Where a message is unclear, a limited manual review may occur to reach a final determination. Messages identified as abusive or suspicious may be blocked without prior notice to the sender.
We may use non-identifiable and anonymized information about how customers use the Service for marketing, publicity, or educational purposes. For example, we may state publicly that "a customer scheduled a message 10 years into the future" without revealing your identity, email address, recipient details, or the actual content of your message.
We will never disclose your personal details or the content of your messages without your explicit consent. Only generic, anonymized usage statistics or examples may be shared.
The Service is provided on an "as-is" and "as-available" basis. While we will make commercially reasonable efforts to deliver your scheduled email(s) on the designated date(s), we do not guarantee delivery in all circumstances.
You acknowledge and agree that:
To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, whether incurred directly or indirectly, or any emotional distress or other intangible losses, arising out of or in connection with your use of the Service. Our maximum liability to you shall not exceed the total amount you paid us for the Service in question.
The option to schedule messages up to one hundred (100) years into the future is offered as a feature of the Service. However, you acknowledge and agree that we do not guarantee the continued operation of the Service, infrastructure, or technology for the full duration of this period. Your purchase covers the scheduling and storage of your message up until the scheduled date, but not a guarantee of delivery.
No refunds or compensation will be provided if the Service is discontinued or unable to deliver messages due to business closure, technological obsolescence, legal restrictions, or events beyond our control.
We shall not be held responsible or liable for any failure or delay in performance of the Service caused by events beyond our reasonable control, including but not limited to natural disasters, government actions, wars, cyberattacks, power outages, or internet failures ("Force Majeure Events").
You agree to indemnify, defend, and hold harmless The Legacy Email, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
We take reasonable measures to safeguard your stored messages. However, no system is completely secure. In the event of unauthorized access, data breach, or system failure, we will take reasonable steps to investigate and remedy the situation, but we are not liable for any resulting damages, losses, or claims.
We employ reasonable and industry-standard technical and organizational measures to protect your data and the Service against unauthorized access, misuse, and other security risks. However, no system is completely secure and we cannot guarantee absolute protection.
Automated reviews by third-party AI providers are an additional security layer; however, their outputs are probabilistic and not infallible. We do not guarantee perfect detection, and we may take protective actions based on these automated results.
We reserve the right to refuse service or cancel a scheduled email without a refund if we determine, at our sole discretion, that a user has violated these Terms.
We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
You must confirm acceptance of these Terms before scheduling or submitting payment. The payment and scheduling process cannot proceed unless you have actively agreed to the Terms on the checkout screen. We do not store a separate record of your acceptance, but your confirmation is required and verified at the time of order initiation.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of India.
If you access the Service from outside India, you are responsible for compliance with local laws. Regardless of your location, you agree that the governing law and exclusive jurisdiction for disputes will remain with the courts of India.
