1. Agreement to Terms

By using our service, The Legacy Email ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and TheLegacy.Email ("we," "us," or "our").

The Legacy Email provides a platform for users to write, schedule, and send emails to specified recipients at a future date, ranging from one (1) year to one hundred (100) years from the date of scheduling. The Service does not require user accounts. Once an email is scheduled and paid for, our system will store the content and attempt to deliver it on the scheduled date(s).

You are solely responsible for the content you create and the information you provide. By using the Service, you agree to the following:

4. Fees, Payment, and Refunds

The Service is fee-based. The price for scheduling an email is calculated based on the number of scheduled sending events and their respective delivery dates, as detailed on the main page. All payments are processed through secure third-party payment gateways (e.g., Stripe, Paddle). We do not store your full credit card information.

Due to the long-term nature and operational costs of storing and guaranteeing the future delivery of your message, all purchases are final. **We do not offer refunds once an email has been successfully scheduled and paid for.**

5. Intellectual Property

You retain full ownership and all intellectual property rights to the content (subject and body) of the emails you create. We claim no ownership over your content.

The branding, design, and source code of The Legacy Email service are our exclusive property and are protected by copyright and other intellectual property laws.

6. Disclaimers and Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis. We will make all reasonable efforts to ensure your email is delivered on the scheduled date. However, we cannot guarantee delivery in all circumstances, as it depends on factors beyond our control, including but not limited to: the continued existence of the internet, the recipient's email provider accepting the email, and the validity of the recipient's email address at the future date.

To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any emotional distress or other intangible losses, resulting from (a) your use of the Service; (b) the failure of a scheduled email to be delivered; or (c) the content of any email sent via the Service. Our total liability to you for any claims arising from the use of the Service is limited to the amount you paid us for the Service in question.

We reserve the right to refuse service or cancel a scheduled email without a refund if we determine, at our sole discretion, that a user has violated these Terms.

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
